You have to abide by the laws of the state you are in....and California does not recognize the "finders keepers" rule.

Is this kid getting railroaded or is he being held responsible?

He sold the device to Gizmo for 5K

Me personally...he is guilty

If you find a unlocked chevette on the street with the keys in it, in a public parking spot...you would still be charged with auto theft...even though you would not get 5 K for it...

He clearly knew what it was, and if he did not, after he found out he was getting 5k for it he should have looked up the laws....

Ask for youthful offender status kid....or go to the makers to help them bring down Gizmo

obvious hoax to stir up attention before release. any attention better than no attention. kid will be working for apple upon college graduation.
