Leyritz bond revoked

Ex-Yankee Leyritz’s bond revoked after positive alcohol tests

Former Yankee Jim Leyritz could be headed to jail today after the judge in his DUI manslaughter case revoked his bond because he tested positive for alcohol while driving.

“Right now Jim’s at home, but he may have to turn himself in,” Leyritz’s attorney, David Bogenschutz, told me this morning.

Said State Attorney’s Office spokesman Ron Ishoy: “One of the conditions of his bond was he was not allowed to consume alcohol. Records from the ignition Interlock device on his car indicated that he had consumed alcohol.”

Bogenschutz said Leyritz tested positive for alcohol four times since September, including a Jan. 9 incident while driving.

Leyritz, 45, of Davie, faces a DUI manslaughter charge for a Dec. 28, 2007 wreck in Fort Lauderdale that killed Fredia Veitch.

“I find this shocking that he would even attempt to drive after he has been drinking,” Jack Veitch, Fredia’s father-in-law, wrote to me in an e-mail.

Bogenschutz said there was a misunderstanding over whether the terms of Leyritz’s original bond applied after April 2008, when Leyritz’s case was no longer supervised by the Pre-trial Services division of the Broward Sheriff’s Office.

Bogenschutz has requested an emergency hearing before Broward Circuit Judge Marc Gold to sort out the situation. Gold signed the warrant revoking bond on Thursday.

No word yet if the hearing will be held later today or after the holiday weekend.

Bogenschutz said a pickup order for Leyritz has not been filed with the Clerk of Court or the Sheriff’s Office, but that Leyritz would surrender if it is.
