Question Question to landlords

well i got one for you guys that is just pissin me off and it just seems as if i have no rights at all as a homeowner/landlord

last month i evicted a looser scum bag of a tennant. 2 months behind in rent, caused over $1000 damage to the place, and had constant traffic in and out of the house cuz of drugs. (he is not signed into any type of lease at all)

i went the proper way thru the sheriffs dept and they severd the scumbag a 3day or vacate as well as a 30 notice to vacate (just to be safe). i didnt give 2 shits about gettin my back rent or even getting the $$ for all the damages, i just wanted this scumbag gone.

a day or 2 after being served we saw him (and a friend that lived there with him) packing shit and what looked liked getting out. 3 1/2 weeks passed and nobody came back around- the mail was all piled up and the utilities were all shut off. there was a bunch of garbage- crack pipes, flat burned spoons 5-6 needles and some bullshit broken old junk that was left behind. we packed what was left in the house and put it in our shed.

this afternoon (32 days after being served) the scumbag shows up wanting to get in the apt. i told him to get lost and i was going to call the cops if he didnt get out of my yard. so the cops were called and showed up and i explained what was going on- THIS IS WERE I ABOUT LOST IT- the flatfoot said he has all the right to go back in that apt if he wants. i was told he has just as much right being there as i do. WTF???????? they said i have to take him thru civil court to actually get him evicted.

so now i have to go thru the court system to get him evicted- i just cant figure this bullshit out to save my life.

anyone have any advice???

oh and by the way he has another apt and is just doing this cuz the fuk face dirtbag knows how to play the system and is doing anything to fuk me

You will need a court order to evict. New York has some of the most strictest laws when it comes to renters. I know it sounds shi**y, but that`s what you`ll have to do. Go to the court house and see what they say. If they can`t help you get a lawyer if you don`t already have one. They will take care of it for you. That`s why the police told you they have rights also.

Being a landlord is a pain in the ass. States like NY make it even worse. Go down to the courthouse. They will have all the details on everything you need to do.

thanx guys for taking a few minutes and helping me !!!

i went to the courthouse and got things rollin

all set up with a good lawyer as well- the countys former DA (he's a high school buddy with the old man)

the dirtball wants to go this way- fine by me now im going after his ass for everything

new york state is the worse for landlords

hope it all ends well dude...im a reanter ...been in the same place now for nearly 8 years and i think the landlord wud have a fit if we told him we were leaving lol....we redid the place and looks 1000 times better than it did....good luck any way dude and hope u get a good renter in the future!
