Rush Limbaugh is detained at Palm Beach airport after being found with Viagra

Rush Limbaugh was briefly detained Monday at Palm Beach International Airport when customs agents inspected the conservative talk show host's luggage and found Viagra that belonged to two Florida doctors, authorities said.

"He was not arrested," Palm Beach County sheriff's spokesman Sgt. Pete Palenzuela said.

Limbaugh's attorney, Roy Black, issued a statement through a spokesman saying that agents found a "non-narcotic prescription drug, which had been prescribed by Mr. Limbaugh's treating physician but labeled as being issued to the physician rather than Mr. Limbaugh for privacy purposes."

Limbaugh, 55, of Palm Beach, and three others arrived on a private jet from the Dominican Republic to the General Air Facility at PBIA on Monday afternoon, the U.S. Customs and Border Protection Service said.

Agents searched the plane during a routine customs inspection and found a pill bottle that was not in Limbaugh's name, said Jennifer Connors, a Customs and Border Protection spokeswoman. Agents confiscated the medicine and called the Sheriff's Office, which took over the investigation.

"Mr. Limbaugh was cooperative. He gave a statement that he had a bottle in his possession and that it was Viagra," said sheriff's spokesman Paul Miller, who noted that the prescription was filled in Florida.

Sheriff's deputies interviewed Limbaugh at the airport before he left shortly after 5 p.m.

Investigators will send a package with evidence and witness statements to the Palm Beach County State Attorney's Office so prosecutors can determine what charges, if any, would be filed. "We did the same thing to him that we would do for any other person under the same circumstances," Miller said.

Attempts to reach Limbaugh's attorney by phone Monday evening were unsuccessful. Limbaugh, who is heard locally on WJNO, AM 1290 , did not issue a statement on his Web site, www.rushlimbaugh.com by late Monday.

Just one month ago, Limbaugh signed a deal with prosecutors following a high-profile and long-running investigation into allegations of doctor shopping for prescription pain killers.

Investigators alleged that Limbaugh obtained overlapping prescriptions from three doctors, one in New York and two in Palm Beach County, without telling them.

While Limbaugh received treatment for back pain at a Jupiter outpatient surgery center, he signed a pain-management contract that required him to get all his drugs from the center and reveal which pharmacy he would use to fill the prescriptions, court documents show.

Limbaugh drew the attention of investigators after his former housekeeper went to prosecutors in December 2002 and told them she and her husband sold Limbaugh large quantities of the painkillers hydrocodone and OxyContin as well as other prescription drugs for several years.

Under the agreement, which was announced as prosecutors were considering taking their evidence to a grand jury, Limbaugh was briefly booked into the Palm Beach County Jail on the felony doctor-shopping charge. He was fingerprinted and released within an hour after posting $3,000 bail. Some sheriff's deputies greeted him and shook his hand.

Limbaugh agreed to supervision for 18 months while he continued his rehabilitation with the therapist who has treated him since he admitted to a painkiller addiction in October 2003 and entered a month-long treatment program. The agreement also calls for Limbaugh to undergo drug testing and pay $30,000 toward the cost of the investigation, prosecutors said.

During that time, Limbaugh can't own a gun, can't use "intoxicants to excess" and must remain gainfully employed.

If Limbaugh successfully completes the terms of his 18 months of supervision, the felony charge will be dismissed and his record will be clean.

It was not immediately clear whether Monday's incident would affect the agreement with the State Attorney's Office. However, a spokesman for the office said that, generally, a person on drug offender probation is prohibited from possessing narcotics and that Viagra does not fall in that category.
