NBA owns the shoes

NBA WANTS DONAGHY TO PAY FOR SHOES

6/21/2008 12:33:26 PM

NEW YORK - The NBA is so angry at disgraced referee Tim Donaghy that it wants him to reimburse the league for the cost of his basketball shoes.

The NBA said in a court filing it spent US$750 over three seasons to buy sneakers for Donaghy, who pleaded guilty last year to taking payoffs from gamblers.

Now, the league wants its money back. It also wants a court to force the referee to repay his salary, his airfare expenses and meal allowances, and cough up at least $4,500 for complimentary tickets he received over the years. All told, the league is seeking $1.4 million from Donaghy.

The written demand was filed Thursday at a federal court in Brooklyn.

Donaghy's lawyer has called the league's demands an attempt to retaliate against his client for alleging widespread misconduct by NBA executives and employees.

Donaghy has admitted betting on about half the games he officiated for three seasons, beginning in 2003.

i dont understand how they can get any of that...unless it states it in his contract that termination of contract for any kind of rules infraction would require the reimbursement

Donaghy should just return the shoes and call it even.

he shouldnt even have to do that...hell the shoes are part of the uniform and if the league agrees to pay for the employees' uniforms, why would any sort of reimbursement be required or expected?

the fans that attended any of his games should be able to sue the nba for violation of contract of offering a quality product...it is their fault that this happened...they should have taken decent precentive measurements to make sure nothing like that could have happened...the nba is as guilty as donaghy is

YES.....on the same premise as that lawsuit against the casino for not evicting the person from the premises.

The NBA did not do enough to prevent corruption amongst its officials.....thus did not preserve the integrity of the game.

Now its not just the shoes.....

NBA demands $1.4 million from disgraced referee

By TOM HAYS, Associated Press Writer

Jun 20, 20:30 EDT

In this April 10, 2007 file ph…

AP - Jun 10, 6:21 pm EDT NBA Gallery NEW YORK (AP)—The NBA wants disgraced referee Tim Donaghy to pay the league $1.4 million, including his wages for games on which he bet or provided inside tips to gamblers.

The written demand, filed Thursday in federal court, asks a judge to force Donaghy to pay the sum as restitution in his gambling case. The league previously indicated it would seek $1 million.

The Donaghy scandal “has harmed the NBA and caused it to spend vast sums to undo that harm,” league lawyers wrote.

In an earlier filing, defense attorney John Lauro accused the NBA of trying to extract the money to punish Donaghy for embarrassing the league with allegations of widespread misconduct by executives and employees—including claims that referees rigged games by making bad calls. The league has denied the accusations.

The NBA “provides no support whatsoever for the demand, which appears to be a transparent effort to intimidate Mr. Donaghy,” Lauro wrote.

Both sides are expected to argue the issue next week in court in Brooklyn.

Donaghy, 41, pleaded guilty last year to felony charges of taking cash payoffs from gamblers and betting on games himself. He faces up to 33 months in prison at sentencing, set for July 14.

Donaghy has admitted betting on about half the games he officiated for three seasons, beginning in 2003. The NBA argues that he consequently owes the league roughly half his wages for that period: $504,719. The league also claims he should pay back an additional $72,593 for the 16 games on which he provided tips to gamblers during the 2006-2007 season.

Finally, Donaghy should foot the bill for the legal fees and other expenses related to an internal “risk review” prompted by the case, the NBA said.

The expenses include pay for two league employees who spent 125 hours—at $270 per hour and $100 per hour—reviewing videotapes of games Donaghy refereed. The NBA also wants Donaghy to pick up the $516,971 tab for a law firm that interviewed 57 NBA referees as part of the internal investigation.

How do you justifying paying 2 people (league employees) $370/hour to watch tapes of games officiated by Donaghy???

People watching their games at home don't get paid.
